Terms of Service
Effective Date: August 1, 2026
These Terms of Service (“Terms”) explain how Kleer Blue Water™ works, what you can expect from our Services, and the responsibilities that help your kit, sample, results, and digital account function properly. The terms “Kleer Blue Water™,” “we,” “us,” and “our” refer to Kleer Blue Water, LLC. "Services" means our website, consumer water testing kits, sample collection and shipping logistics, coordination of laboratory testing, customer support, customer portal and Dashboard, reports and results displays, educational content, any membership or loyalty program features, any recurring testing program, and any AI-powered tools made available by Kleer Blue Water™ (including Kleer Blue Guide and the Water Quality Assistant).
By purchasing a kit, creating an account, submitting a sample, accessing your Personalized Dashboard, using our website, or using any other part of the Services, you agree to these Terms and represent that you are at least 18 years old and have the legal capacity to enter into these Terms. If you do not agree, you should not use the Services.
Please read these Terms carefully. They include important information about sample collection, results, AI-powered tools, membership or recurring testing programs, refunds and replacements, limitations of our Services, and dispute resolution.
1. Our Services
Kleer Blue Water™ provides consumer water testing kits, coordinates sample submission to an independent, accredited environmental laboratory, displays testing results through a digital Dashboard, and provides educational information to help customers better understand their water results. We describe the laboratory as accredited based on the laboratory’s representations to us. Accreditation applies to specified methods and analytes within the laboratory’s accreditation scope, which may change over time. Not every analyte or method may be within that scope at any given time. We may use substitute laboratories or methods when appropriate.
Kleer Blue Water™ reports testing results and, where applicable, provides comparisons to recognized standards, guidelines, or reference values. These comparisons are provided for informational context and do not constitute a legal, regulatory, medical, or safety determination.
2. Availability
Kleer Blue Water™ kits are currently available in the United States, excluding Alaska, Hawaii, U.S. territories, and international addresses. Availability may vary based on your location and applicable legal, regulatory, or laboratory requirements. We may route samples to a different qualified laboratory, delay processing, decline to process a sample, or cancel an order based on your location or other compliance considerations. If we cannot lawfully or practicably provide the Services for your location or process your sample, we will cancel your order and refund you in full to the original payment method.
3. Kits and Standard Product Options
Kleer Blue Water™ kits are standard product offerings and are not customized for individual customers. Kleer Blue Water™ currently offers City Core, City Complete, City Comprehensive, Well Core, Well Complete, and Well Comprehensive kits. Product availability, kit contents, and kit descriptions may change over time. If there is any conflict between a kit description and the instructions included with your kit, the instructions included with your kit will control.
Each kit includes the materials needed for the tests included in that kit. Your results are limited to the specific tests included in the kit you purchased. Our Services do not test for every possible substance, contaminant, water quality issue, or condition that may affect your water.
4. Orders, Payment, and Promotions
When you place an order, you are asking Kleer Blue Water™ to provide the kit and related Services described at checkout. Kleer Blue Water™ may refuse or cancel an order for reasons such as unavailable inventory, shipping limitations, suspected misuse, legal or compliance concerns (including location-based laboratory or reporting requirements), pricing or listing errors, suspected fraud, or other reasons determined by Kleer Blue Water™. If we cancel an order after payment has been collected, we will issue a refund to the original payment method. Any delivery dates or turnaround times we provide are estimates only and are not guaranteed.
Prices are displayed in U.S. dollars and do not include applicable taxes or shipping/handling charges unless stated at checkout. Promotions, discounts, or special offers may be subject to additional terms, eligibility requirements, or expiration dates stated at the time of the offer.
5. Membership and Recurring Testing Programs
Kleer Blue Water™ may offer a free membership, loyalty, or customer community program that provides access to benefits, educational content, promotions, reminders, or other program features. Participation is optional and, where required by applicable law, will be offered on an affirmative opt-in basis. Program benefits may change over time and will be described where the program is offered.
If we offer a paid recurring testing plan in the future, the pricing, renewal schedule, billing terms, cancellation process, and other applicable terms will be provided at the time of enrollment.
Membership or program-related emails may include educational content, promotions, reminders, or other information related to Kleer Blue Water™. You may unsubscribe from marketing emails as described in those messages, though we may still send transactional or service-related communications connected to your orders, account, kits, samples, results, or support requests.
6. Communications, Email, and SMS/Text Messages
We may communicate with you by email, through your account, through the website or Personalized Dashboard, and through other reasonable methods related to your order or use of the Services. These communications may include order updates, account notices, sample or shipping information, results notices, support responses, membership or recurring testing information, educational content, and retesting reminders. You acknowledge that communications may be delayed or may not be received due to factors outside our control (such as email filtering, carrier issues, or device settings), and you are responsible for monitoring your account and contact information.
If you choose to provide a phone number and opt in to SMS/text messages, Kleer Blue Water™ may use SMS/text messages for order tracking and order notifications. Kleer Blue Water™ does not use SMS/text messages for marketing. By opting in, you authorize us to send you text messages using an automatic telephone dialing system or other technology. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP, and you can get help by replying HELP. Carriers are not liable for delayed or undelivered messages. If you do not opt in to SMS/text messages, order-related communications will generally be handled by email or other available methods. Your use of SMS/text messages is subject to our Privacy Policy.
7. Accounts and Customer Information
You may need to create or access an account to register a kit, submit information, receive a sample shipping QR code or label, view results, or use other parts of the Services. You are responsible for keeping your account login information reasonably secure and for all activity that occurs through your account. If you believe your account has been accessed without permission, please contact Customer Support promptly.
You should provide accurate account, contact, shipping, sample location, and water-source information where requested. Incorrect or incomplete information may affect shipping, communications, account access, sample identification, or how information is displayed in your Personalized Dashboard.
If you notice that any account, shipping, sample location, or water-source information is incorrect, please contact Customer Support as soon as possible. We will make an effort to help correct it where reasonably possible. Some corrections may not be possible after a sample has been submitted, testing has begun, or results have already been generated.
We may suspend or terminate your access to the Services (including your account or Dashboard access) if we reasonably believe you have violated these Terms, misused the Services, or used the Services in a way that creates risk to Kleer Blue Water™ or others.
8. Age and Minor Use
The Services are intended for adults. You must be at least 18 years old to purchase a kit, create an account, submit a sample, or otherwise accept or use the Services. If you allow another person to use a kit or view results, you are responsible for ensuring that use is supervised as appropriate and complies with these Terms.
9. Sample Collection and Submission
Water samples can be time-sensitive. To help the testing process work properly, you must collect and send samples according to the kit-specific instructions provided with your kit, because different kits or tests may have different timing, handling, or shipping requirements. You should collect your sample only when you are ready to send it to the laboratory within the required kit-specific window.
You must use the sample containers, materials, labels, packaging, and shipping materials provided with your kit. You should not substitute your own bottles, bags, labels, packaging, or other materials.
For sending samples to the laboratory, you must use the prepaid sample-shipping process provided with your kit. This may include using a provided QR code or label and a staffed FedEx drop-off location so the label can be printed and the sample can be accepted for shipment. Drop boxes should not be used to send your sample to the laboratory. You should check the location’s same-day shipping cutoff time to help ensure the sample ships the same day when required by the kit instructions.
If you have questions about the sample collection or shipping instructions, please contact Kleer Blue Water™ before collecting your sample. A sample may be rejected or may not be processed if, for example, it is collected or shipped outside the kit-specific window, is leaking, is improperly labeled, has insufficient volume, is damaged, is shipped using an unapproved method, or otherwise does not comply with the kit instructions. If a sample cannot be processed because instructions were not followed, Kleer Blue Water™ generally will not provide a free replacement, although we may review unusual circumstances and any refund or replacement will be governed by our Refunds & Replacements Policy.
Please collect and send your sample within 90 days of receiving your water testing kit. If more than 90 days have passed, please contact Customer Support before collecting the sample so we can confirm that the kit instructions, sample materials, and shipping process are still current.
10. Authority to Submit a Sample
By submitting a sample, you confirm that you are collecting it from a location where you are authorized to access and collect water, such as your home, apartment, rental unit, workplace, or another location where you have permission to collect the sample.
11. At-Home Tests and Customer-Reported Results
Kleer Blue Water™ kits may include at-home tests that you perform yourself and report to Kleer Blue Water™. These customer-reported results may appear in your Personalized Dashboard alongside laboratory-generated results.
Because at-home tests are performed and reported by the customer, Kleer Blue Water™ is not responsible for errors caused by how the test is performed, timed, read, interpreted, photographed, transcribed, or entered into your Personalized Dashboard. Customer-reported results are distinct from laboratory-generated results.
12. Results Are a Point-in-Time Snapshot
Results reflect the specific water sample submitted and the specific point in time when it was collected. Water quality is dynamic and can change over time, including due to sampling conditions (such as which tap was used, stagnation time, aerators/filters, flushing practices, or collection technique). Certain events or conditions — such as plumbing conditions, municipal system changes, weather events, nearby construction, or treatment systems — may affect results at a given moment.
13. Informational Use and Limits of Testing
Kleer Blue Water™ provides informational water testing and educational context. We report testing results and, where applicable, provide comparisons to recognized standards, guidelines, or reference values. These comparisons do not determine whether water is legally “safe” or “unsafe” under federal, state, or local law. The Services and any reports, results, Dashboard content, reference values, and educational materials are for your personal informational use only and are not intended to be used, and may not be used or relied on, to satisfy any legal, regulatory, permitting, real-estate, lender, insurance, landlord, lease, code-compliance, litigation-evidence, or public water system requirement. Reference values may include enforceable standards, health-based guidelines, or aesthetic/educational benchmarks and may vary by jurisdiction and water system type.
You may share your reports or results at your discretion, including with professionals, but Kleer Blue Water™ does not represent that any report or result is valid for any official purpose, and we are not responsible for third-party reliance or use of your reports or results.
Your results are limited to the specific tests included in the kit you purchased. The Services are not designed to identify every possible substance, contaminant, water quality issue, or condition that may affect your water.
Certain test results may be subject to mandatory reporting or disclosure requirements by laboratories or other parties under applicable law. You acknowledge and agree that we and our laboratory partners may disclose information, including test results, if required by law or legal process.
Kleer Blue Water™ may update Dashboard content, educational explanations, reference values, display formats, and product features over time as standards, guidelines, science, technology, or our Services evolve. If we update educational content or reference values later, that does not necessarily mean prior results were incorrect; it may mean the way results are explained, compared, or displayed has changed over time.
14. Common Treatment Information, Professional Services, and Third-Party Resources
Kleer Blue Water™ may provide educational information about water quality findings, reference values, and commonly available treatment technologies. However, we do not provide plumbing, filtration installation, remediation, medical, legal, regulatory, or other professional services. Any decision about treatment, repairs, installation, or health-related action should be made with an appropriate qualified professional.
Kleer Blue Water™ kits involve sample collection, shipping, laboratory analysis, and digital reporting. They are not designed for situations where you need immediate information about a potential health or safety concern. If you believe you need immediate guidance about your water, contact your local water authority, health department, medical professional, or another qualified professional.
Our Services may include links to third-party websites or resources, such as public agencies, regulatory bodies, educational resources, shipping providers, or other operational service providers. These links are provided for convenience and informational purposes only. Kleer Blue Water™ does not control third-party websites or services and is not responsible for their content, availability, practices, or outcomes.
Kleer Blue Water™ does not link to or name specific filtration products, brands, installers, plumbers, or treatment companies as part of the Services.
15. Sharing Reports and Results
You may share Kleer Blue Water™ reports, Dashboard content, or results with water professionals, plumbers, filtration professionals, medical professionals, or other qualified professionals. Kleer Blue Water™ is not responsible for how any third party interprets, relies on, or uses that information. Except as expressly stated in these Terms, there are no third-party beneficiaries to these Terms.
16. Digital Services, Portal, Dashboard, and AI-Powered Tools
Kleer Blue Water™ may provide digital features, including our website, customer portal, Dashboard, reports, AI-powered tools, and other online features. We make reasonable efforts to keep these features available and working properly, but they may occasionally be unavailable due to maintenance, updates, technical issues, service providers, or circumstances outside our control. We may modify, suspend, or discontinue any digital feature (including AI-powered tools) at any time.
AI-Powered Tools
Kleer Blue Water™ may provide AI-powered tools to help customers better understand our products, testing process, Dashboard, and educational materials. These tools may include Kleer Blue Guide and the Water Quality Assistant.
Kleer Blue Guide is an AI-powered assistant available on the Kleer Blue Water™ website. It is designed to help answer general questions about our kits, ordering, shipping, sample collection, sample return, returns, and the testing process.
The Water Quality Assistant is an AI-powered assistant available within the customer dashboard. It is designed to help customers understand Dashboard content, test results, tested substances, reference values, and approved Kleer Blue Water™ educational materials.
These AI-powered tools are provided for informational and educational purposes only. They are not human experts, water professionals, medical professionals, legal advisors, or regulatory advisors. They do not provide medical advice, safety determinations, individualized treatment recommendations, emergency instructions, or legal or regulatory compliance conclusions. AI-generated responses may be inaccurate, incomplete, or out of date and you should rely on your laboratory-generated results and your Personalized Dashboard report as the authoritative source for your results.
Kleer Blue Guide and the Water Quality Assistant may respond based on approved Kleer Blue Water™ materials, curated educational content, customer account context, Dashboard content, test results, and information provided by the customer during the interaction. Customer-specific information is intended to be used only to support that customer’s own experience and is not intended to be used to answer other customers’ questions.
Kleer Blue Water™ may review, summarize, or evaluate AI assistant interactions to improve customer support, FAQs, Dashboard language, educational materials, AI prompts, and AI guardrails, subject to our Privacy Policy. Kleer Blue Water™ does not authorize third-party AI providers to use customer conversations or test results to train their general AI models.
Customers should not rely on AI-powered tools as a substitute for professional advice. Customers with health-related questions should consult a qualified medical professional. Customers with treatment, filtration, plumbing, or remediation questions should consult a qualified water professional, plumber, filtration professional, or other appropriate professional.
17. Privacy Policy and Incorporated Policies
Our Privacy Policy explains how we collect, use, disclose, and protect personal information. Our Refunds & Replacements Policy explains when refunds or replacements may be available. Both policies are incorporated into these Terms by reference and are part of the agreement between you and Kleer Blue Water™. If there is a conflict between these Terms and an incorporated policy, these Terms will control to the extent of the conflict, except that the Privacy Policy will control with respect to disclosures about personal information practices.
18. Intellectual Property
All content, features, designs, and materials available through the Services — including the Kleer Blue Water™ name, logo, trademarks, website content, software, customer portal functionality, portal and dashboard design, report structure, educational content, substance/analyte presentation, data organization, visual systems, Dashboard logic, and results-display methods — are owned by Kleer Blue Water™ or its licensors, may not be used except as expressly permitted by these Terms, and are protected by applicable intellectual property and other laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use.
You may use the Services for your personal, non-commercial use. You may not copy, reuse, modify, distribute, scrape, reverse-engineer, create derivative works from, or commercially exploit any part of the Services without our written permission.
19. Feedback and Suggestions
If you provide feedback, ideas, suggestions, comments, or other input about Kleer Blue Water™ or our Services, you allow us to use that input to improve our Services, content, products, customer experience, and digital tools without compensation to you. Any personal information we collect or use in connection with your feedback is handled as described in our Privacy Policy.
20. Responsible Use of the Services
You may not misuse the website, portal, Dashboard, AI tools, kits, reports, or other Services. This includes unauthorized access, scraping, interfering with systems, unlawful use, commercial exploitation, resale, or unauthorized third-party use without our written permission. You may not probe, scan, or test the vulnerability of the Services, attempt to breach security or authentication measures, or use any automated means (including bots or scrapers) to access the Services except as expressly permitted in writing by us.
21. Corrections to Errors
We make reasonable efforts to keep our website, product information, Dashboard content, reports, and educational materials accurate and up to date. However, errors, inaccuracies, or omissions may occasionally occur. Kleer Blue Water™ may correct errors, inaccuracies, or omissions when identified, including after an order has been placed or results have been displayed. If a pricing or listing error affects an order, we may cancel the order and issue a refund.
22. Disclaimer of Warranties
KLEER BLUE WATER™ IS DESIGNED TO HELP YOU BETTER UNDERSTAND THE WATER SAMPLE YOU SUBMIT. OUR SERVICES PROVIDE TESTING RESULTS, EDUCATIONAL INFORMATION, DIGITAL TOOLS, AND COMPARISONS TO RECOGNIZED STANDARDS, GUIDELINES, OR REFERENCE VALUES WHERE APPLICABLE.
WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, IDENTIFY EVERY POSSIBLE WATER QUALITY ISSUE, PREVENT ILLNESS, PREVENT PROPERTY DAMAGE, RESOLVE WATER-RELATED PROBLEMS, OR BE SUITABLE FOR EVERY PURPOSE. TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES, KITS, RESULTS, DASHBOARD, PORTAL, AI-POWERED TOOLS, AND RELATED CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
23. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, KLEER BLUE WATER™ AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LABORATORY PARTNERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICES, ANY RESULTS OR REPORTS, ANY RELIANCE ON RESULTS OR THE AI-POWERED TOOLS, ANY DECISION ABOUT TREATMENT OR USE OF WATER, ANY CUSTOMER-REPORTED AT-HOME TEST, OR THE ACTS OR OMISSIONS OF ANY LABORATORY OR THIRD-PARTY PROVIDER, UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, KLEER BLUE WATER™’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A KIT OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO KLEER BLUE WATER™ FOR THE KIT OR SERVICES GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100). THE EXCLUSIONS AND LIMITS IN THIS SECTION APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
24. Responsibility for Misuse
To the fullest extent permitted by law, you will defend, indemnify, and hold harmless Kleer Blue Water™ and its owners, officers, employees, contractors, affiliates, laboratory partners, and service providers from and against any third-party claim, demand, loss, damage, liability, and reasonable cost (including reasonable attorneys’ fees) arising out of or relating to: (a) your misuse of the Services; (b) your violation of these Terms or any law; (c) your violation of any third-party right; (d) inaccurate or incomplete information you provide; (e) your collection, handling, or submission of a sample; or (f) your sharing of, or any third party’s reliance on, your reports or results. We will give you reasonable notice of the claim and may, at our option, control the defense; you will reasonably cooperate and will not settle in a way that binds an indemnified party without our written consent. This section does not limit any rights you may have under applicable law.
25. Dispute Resolution, Arbitration, and Class Action Waiver
If a dispute arises between you and Kleer Blue Water™, we encourage you to contact Customer Service first so we can try to resolve the issue. If a dispute cannot be resolved informally, it will be resolved through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules (and, if applicable, any AAA supplementary rules then in effect), except that either party may bring an individual claim in small claims court if the claim qualifies. This arbitration agreement is governed by the Federal Arbitration Act (9 U.S.C. §§ 1–16).
ALL ARBITRATION PROCEEDINGS WILL BE CONDUCTED ON AN INDIVIDUAL BASIS ONLY AND NOT AS A CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY AWARD RELIEF ONLY IN FAVOR OF THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO PROVIDE RELIEF WARRANTED BY THAT PARTY’S INDIVIDUAL CLAIM. The arbitration will be based in Chicago, Illinois, with remote arbitration allowed where appropriate or required by the AAA rules. The arbitrator (and not a court) will have the exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or any part of this arbitration agreement is void or voidable. Payment of AAA filing, administration, and arbitrator fees will be governed by the AAA Consumer Arbitration Rules. Information about AAA and the AAA Consumer Arbitration Rules is available at www.adr.org. Unless applicable law provides otherwise, each party will bear its own attorneys' fees and costs, and we will not seek attorneys’ fees and costs from you unless the arbitrator determines your claim is frivolous or brought for an improper purpose.
If the prohibition on class, collective, consolidated, mass, or representative actions is found to be unenforceable with respect to a particular claim or request for relief, then (to that extent only) that claim or request for relief will not proceed in arbitration and will proceed only in a court of competent jurisdiction, and the parties agree that any such proceeding will be stayed pending the outcome of any remaining arbitrable claims.
You may opt out of arbitration by providing written notice to Kleer Blue Water™ within 30 days after you first accept these Terms. Your opt-out notice should include your name, mailing address, the email address associated with your account (if any), and a clear statement that you are opting out of arbitration. Opting out of arbitration does not affect any other part of these Terms.
26. Governing Law and Courts
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. For disputes not handled through arbitration, the parties agree to the state and federal courts located in Cook County, Illinois, where permitted by law. Notwithstanding the foregoing, Kleer Blue Water™ may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property, confidential information, or the security or integrity of the Services.
27. Changes to These Terms
Kleer Blue Water™ may update these Terms from time to time. When we do, we will post the updated Terms with a new effective date. Changes apply on a prospective basis from the effective date, unless we are required by law to apply them differently. Except as otherwise required by applicable law, Kleer Blue Water™ is not obligated to provide individual notice of every update to these Terms.
For customers with an active membership program or recurring testing plan, Kleer Blue Water™ will make reasonable efforts to notify them of material changes that affect billing, renewal, cancellation rights, or other meaningful program obligations.
Membership/loyalty programs and any recurring testing plans (if offered) may have additional terms and disclosures presented at enrollment, including benefits, eligibility, billing (if applicable), renewal, and cancellation instructions.
If you enroll in a paid recurring testing plan, you may cancel as described at enrollment, including through any online cancellation method we make available.
28. Standard Legal Terms
If any part of these Terms is found to be invalid or unenforceable, the remaining parts will continue to apply. A waiver of any provision will be effective only if in writing and signed by the party waiving the provision. Our failure to enforce any right or provision is not a waiver of that right or provision and does not waive our right to enforce it later. Sections that by their nature should continue after termination or discontinuation of the Services will continue to apply. Headings are for convenience only and do not affect interpretation. To the extent there is any conflict between this severability clause and the dispute resolution provisions in Section 25, Section 25 controls.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms (in whole or in part) without restriction.
Force Majeure. We are not responsible for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, natural disasters, labor disputes, transportation disruptions, internet or telecommunications outages, service provider failures, governmental actions, or other events of force majeure.
These Terms, together with the Privacy Policy and Refunds & Replacements Policy, form the entire agreement between you and Kleer Blue Water™ regarding the Services and supersede all prior or contemporaneous understandings and agreements on that subject. If there is a conflict between these Terms and an incorporated policy, these Terms control to the extent of the conflict, except that the Privacy Policy controls with respect to disclosures about personal information practices. Except as expressly stated in these Terms, you and Kleer Blue Water™ disclaim any intent to create any rights in or for the benefit of any third party.
Survival. Sections 13 (Informational Use and Limits of Testing), 14 (Common Treatment Information, Professional Services, and Third-Party Resources), 15 (Sharing Reports and Results), 18 (Intellectual Property), 19 (Feedback and Suggestions), 22 (Disclaimer of Warranties), 23 (Limitation of Liability), 24 (Responsibility for Misuse), 25 (Dispute Resolution, Arbitration, and Class Action Waiver), 26 (Governing Law and Courts), and this Section 28 will survive any termination or discontinuation of the Services.
Notices. You agree that we may provide notices to you electronically (including by email, through your account, or by posting a notice in the Services). You may send legal notices to Kleer Blue Water™ by email to Support@KleerBlueWater.com and by mail to the address listed in Section 29. Arbitration opt-out notices must be sent as described in Section 25. Notices will be deemed given when sent by email (if no bounce-back is received) or when delivered by mail.
Termination. We may suspend or terminate your access to the Services as described in these Terms. Upon termination, your right to access or use the Services will end, but your obligations and the provisions that by their nature should survive will remain in effect.
