Introduction

Kleer Blue Water™ ("we," "us," or "our") operates KleerBlueWater.com and the Kleer Blue Water™ customer portal to provide you with water testing services and products (the "Services"). This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase through our Services, or otherwise communicate with us. U.S.-Only Services. The Services are offered only to individuals located in the United States, and we do not target, market to, or knowingly provide the Services to individuals located in the European Economic Area, the United Kingdom, or Switzerland. If you access the Services from outside the United States, you understand that your information may be processed and stored in the United States and subject to U.S. laws.

This Privacy Policy is intended to describe our privacy practices and does not create contractual warranties beyond the disclosures it contains.

A Note on Your Data and Our Independence
Kleer Blue Water™ is a private, independent company. We are not a government agency, a regulatory body, or a municipal water authority.
Your water test results belong to you. We treat your water testing data, which may reflect conditions within your home, with a high level of care.
We do not sell your water test results, and we do not provide your individual results to your municipal water department, the EPA or a state environmental agency, real-estate or MLS services, or insurers or financial institutions for those parties’ own purposes. We may disclose information, including results, where required by law or legal process, to operate the Services (for example, to our laboratory and other service providers), or to protect rights and safety. Laboratories or other parties may be legally required to report certain results to government or local health authorities; where that applies, they will comply.
Personal Information We Collect
The categories of personal information we collect include identifiers and contact information; account and order information; payment-related information (we do not store full card numbers); the precise location or address where your sample is collected; water-source type; sample and kit identifiers linked to your account; water testing results; dashboard activity; AI prompts, outputs, and conversation history; usage and device information; and your communications with us. We treat the precise sample-collection location as sensitive personal information.
Payment information is processed by third-party payment processors through our e-commerce platform. We do not store full credit card or debit card numbers, though we may retain limited transaction details such as billing information or transaction identifiers.
We share unique sample identifiers with laboratory partners to perform testing services. These identifiers do not directly identify you, but may be linked to your account internally.
How We Use Your Information
We use your information to provide and fulfill our Services, process transactions, manage accounts, deliver water testing results, provide customer support, improve our Services, analyze trends, communicate with you, and comply with legal obligations.
We may also use your test data to provide educational information related to your results, including general information about water quality findings, reference values, and commonly available treatment technologies.
We do not use your test results or other health-adjacent information to infer your health status or for targeted advertising. We do not attempt to re-identify information we have de-identified.
We may use aggregated or de-identified information that cannot reasonably be linked to you to improve our Services, develop new features, analyze trends, and better understand water quality patterns.
Use of Automated Tools and AI
We may use automated tools, including AI-based systems, to help explain water test results, reference values, and educational information related to water quality, as well as to respond to customer questions. These tools are designed to provide general informational support and enhance your experience with our Services.
AI-generated responses are based on curated internal content and predefined logic. They are intended for general educational purposes only and do not constitute medical, health, or professional advice.
We do not use AI interactions to infer your health status, to create a health profile about you, or for targeted advertising.
Where appropriate, our team may review or supplement AI-generated responses for quality, safety, and customer-support purposes.
Our use of AI does not result in decisions that have legal or similarly significant effects on you.
Use of AI-assisted features within our Services is optional. If you prefer not to use AI-assisted tools, you may instead use our standard customer support and non-AI features.
AI interactions and related conversation history may be stored and associated with your account to support customer service, maintain continuity within your account experience, troubleshoot issues, enhance platform functionality, and help us improve our Services.
Kleer Blue Water™ does not authorize third-party AI providers to use customer conversations, prompts, outputs, or water testing results to train generalized public AI models.
How We Disclose Your Information
We share personal information with service providers — such as payment, shipping, customer support, cloud-infrastructure, and laboratory partners — that are contractually limited to using it only to provide services to us; this is not a “sale.” Separately, certain advertising or analytics activities may involve sharing limited online identifiers with advertising partners, which may be a “sale” or “sharing” under applicable law and which you can opt out of (see Your Privacy Choices). We do not share your results, dashboard activity, AI conversations, or sample-collection location with advertising partners, and we do not use them for targeted advertising or share personal information with service providers — such as payment, shipping, customer support, cloud-infrastructure, and laboratory partners — that are contractually limited to using it only to provide services to us; this is not a “sale.”
Certain sharing of information with service providers and laboratory partners is necessary for us to provide the Services you request, including processing samples, generating results, maintaining your account, and delivering dashboard functionality.
We work with trusted service providers who are contractually required to process personal information only as needed to provide services to us and not for their own independent purposes.
Cookies, Tracking, and Advertising
We may use cookies and similar technologies to support website functionality, analyze usage, improve user experience, and support advertising and analytics activities.
We may share identifiers such as device information, browsing activity, and interactions with our Services with analytics and advertising partners.
We provide a “Your Privacy Choices” link in the footer of our homepage so you can opt out of the sale or sharing of your information and of targeted advertising. We honor recognized browser-based opt-out signals, including the Global Privacy Control (GPC), where required by applicable law. We do not place third-party advertising technologies, cross-context behavioral advertising technologies, or session-replay tools on logged-in results, dashboard, or AI pages.
Security and Retention
We retain each category of personal information only as long as reasonably necessary for the purposes described in this policy, in accordance with our internal retention schedule, and as required to meet legal, tax, accounting, support, dispute-resolution, and security obligations. When you request deletion, we will delete or de-identify your information subject to those requirements; residual copies may remain temporarily in backup systems.
Certain categories of information, including transaction records, support communications, AI interactions, and account history, may be retained for operational, legal, support, or compliance purposes.

Depending on where you live, you may have the right to access, delete, correct, and obtain a portable copy of your personal information; to opt out of the sale or sharing of your information; and to be free from discrimination in certain jurisdictions, you may also have the right to limit the use of your sensitive personal information. We do not sell personal information for monetary value. However, certain advertising or analytics-related data sharing activities may qualify as “sale” or “sharing” under applicable privacy laws.
We will not discriminate against you for exercising your privacy rights.

We aim to collect only the personal information reasonably necessary to provide and improve our Services.

Sensitive personal information. We treat the precise sample-collection location as sensitive personal information and provide choices to limit its use as required by applicable law and authorized agents. Where required by applicable law, you may use an authorized agent to submit requests on your behalf, and we may take steps to verify the agent’s authority and your identity.
Appeals. Where required by applicable law, you may appeal our decision regarding your request by using the method described in Your Rights.
Children and Age
Our Services are intended for adults. You must be at least 18 years old to use the Services, and we do not knowingly collect personal information from children. If you believe a minor has provided us with personal information, please contact Customer Support and we will take appropriate steps.
